BAT for Ukraine - Improving the framework conditions for the implementation of the European Directive 2010/75/EC on industrial emissions and promoting the use of best available techniques (BAT) in industry

By signing an Association Agreement with the European Union, Ukraine has agreed to comply with EU climate targets and the Industrial Emissions Directive (IED). A key aspect of achieving these national climate targets will be ensuring that best-available techniques (BAT) are deployed in the country’s industrial infrastructure. A regulatory framework for transposing the EU Directive into law has been lacking to date. Accordingly, the project is promoting capacity building in companies and state-run facilities, while providing support to the responsible ministries as they develop the legal framework and monitor compliance. In relation to BAT, the project is aiming to facilitate capacity building for domain experts and management in ministries, for environmental regulators and for plant operators. This, in turn, will enable Ukraine to reduce the greenhouse gas emissions from its industrial sector by the deployment of innovative industrial processes and procedures.

State of implementation/results

 

  • Despite the Russian Federation's attack on Ukraine, the project to implement the Best Available Techniques (BAT) in Ukraine is continuing with a high level of commitment and in good cooperation with the Ukrainian Ministry of Environmental Protection and Natural Resources (MEPR).
  • After several years of preparatory work, Law No. 11355 on the implementation of the EU Industrial Emissions Directive (2010/75/EU, IED for short) was adopted by the Ukrainian parliament, the Verkhovna Rada, on 16 July 2024 in its second and final reading. The IED is the legal basis for the application of Best Available Techniques in Ukraine.
  • The development of the sub-legal regulations that will enable the full implementation of Best Available Techniques in Ukraine is well advanced. The law on the implementation of the IED provides short deadlines for the adoption of secondary legislation. The Ministry of Environment, with the support of GIZ, is therefore working intensively to get these regulations ready for approval.
  • On behalf of the project, international and national companies are developing software that can be used to apply for and issue licences for industrial plants online. Most of the development work has now been completed. Only the electronic implementation of the application form and the format of the actual permit are still outstanding. Following the programming, comprehensive tests are planned.
  • The project has developed a funding mechanism to support Ukrainian companies in implementing the Best Available Techniques. In January 2023, corresponding funding was announced for the first time. Of the total of 25 applications received, 6 were originally selected for funding, but only 3 of these are expected to be realised. Modernisation measures are planned to reduce emissions to air and water and to treat in-house waste in food production and metal production companies. As remaining funds are available, the funding programme has been put out to tender again. Applications were received in particular from the paper manufacturing and food production sectors.
  • The ten translations of BAT reference documents (BREFs) into Ukrainian planned within the project were completed. Following the conclusion of several round tables, which served to generally present and categorise the documents, informal technical working group meetings were held to discuss the translation of leaflets and conclusions on the best available techniques in preparation for implementation.
  • The official kick-off event for the project took place on 9 July 2019 in Kyiv with the participation of a delegation from the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMU). Among those present were Parliamentary State Secretary Rita Schwarzelühr-Sutter and Ukrainian Deputy Environment Minister Mykola Kuzio.
